Public Service Professional
Employees Association, Inc.
This agreement is made and entered
into by and between Public Service Professional Employees Association, Inc,
(herein after referred to as Administrative Contractor or P.S.P.E.A.) and the
Correctional Officers Association of Delaware (herein after referred to as
Union or C.O.A.D.)
Non-Discrimination
The Public Service Professional
Employees Association, Inc., agrees that it shall not discriminate in training,
grievances, safety and health, and all other services outlined in this
agreement, because of race, creed, national origin, political affiliation, sex,
age, marital status or union activity.
Rights
All function, rights and
responsibilities which the Correctional Officers Association of Delaware has
not expressly modified or restricted by a specific provision of this contract
are retained and vested exclusively in the Correctional Officers Association of
Delaware.
Service
Terms
The Public Service Professional
Employees Association, Inc., will provide the following services:
Professional Grievance Representation
1.
Handle
any steps in the department
2.
Representation
at pre-arbitration.
3.
Representation
in Arbitration
4.
Filing
of necessary appeals
5.
AAA
fees are the responsibility of C.O.A.D.
Negotiate and Prepare Collective Bargaining
Agreement
1.
Set
up agenda(s)
2.
Representation
at LMC meetings
3.
Provide
research information
Training Program
1.
Shop
Stewards training
2.
Leadership
Training (Union)
3.
Community
Based Programs
4.
Legislative
Preperation, including Education
Attorney Fees
1.
P.S.P.E.A.
may retain legal counsel in their sole discretion and P.S.P.E.A. will be
responsible for those legal fees from the fees received pursuant to this
contract.
2.
C.O.A.D.
may retain legal counsel in the executive boards sole discretion and C.O.A.D.
will be responsible for the payment of those fees.
Hold Harmless Provision
1.
The
Public Service Professional Employee Association, Inc will be responsible for
maintaining any and all necessary licenses, including state business and other
related licenses, insurance, and shall be responsible for making any necessary
filings, including taxes and lobbying.
2.
The
Correctional Officers Association of Delaware shall be responsible for any
filings necessary in the performance of its duties.
3.
Each
organization shall hold the other organization harmless for any filings or
assessments incurred as a result of a late or omitted filing.
Staffing
The
Public Service Professional Employees Association, Inc will provide skilled
professional staff to handle all matters in this contract.
1.
Staff
will be available and may be contacted twenty four (24) hours a day, seven (7)
days a week.
2.
Staff
supervision, salaries, benefits and other employee related matters are the sole
responsibility of The Public Service Professional Employees Association, Inc
for their employees and are not the responsibility of C.O.A.D.
3.
C.O.A.D.
is responsible for the salaries of its officers, and employees including shop
stewards.
Payment
Payment
shall be made based on the number of members that the State’s vendor sheet
indicates that dues were deducted.
These payments shall be made twice per month and within five (5) working
days after C.O.A.D. receives the payment from the State.
Contract Cost
For
the first year, this contract will cost $8.00 per member per month. The current baseline membership is 1350
officers. P.S.P.E.A. and C.O.A.D. agree
when the membership changes by 6% either way, this term will be reopened to
address the cost based on a sliding scale.
Effective Date and Duration
This
contract shall take effect _____________, 2004 and shall expire on _________
200_.
Amendments and Modifications to this Contract
During
the term of this contract, there shall be no modifications or waiver of its
terms unless by mutual written agreement of the parties. Amendments or modifications shall be
memorialized by a document(s) in writing signed on behalf of the parties hereto
by their duly authorized officers or representatives.
Either
party may give at least forty-five (45) days written notice to the other party
of its intent to emend or modify this contract.
This
agreement shall remain in effect unless either party notifies the other with
just cause or breech of contract, ninety (90) days prior to any annual date.
This
agreement may be terminated by either party for gross misconduct by either
party with a ninety (90) day notice.
This
agreement will terminate immediately if C.O.A.D. is no longer the bargaining unit/representative
for correctional officers up to the rank of sergeant.

Letter of Agreement Between
C.O.A.D. & P.S.P.E.A.
It is agreed between C.O.A.D. and P.S.P.E.A. that should the administrative contract be approved by the C.O.A.D. membership at the special meeting on March 18, 2003, such effective date shall be the date in the Administrative Contract.
Tom
Ridgely and Bill Wharton being service providers to C.O.A.D., and being paid by
C.O.A.D., do agree that any pay, including reimbursements for mileage, tolls or
other expenses received that month shall be deducted from the amount to be paid
under the administrative contract.
